✓ Privacy & Storage: Your study content is stored ONLY locally on your device - we do NOT provide cloud storage or cloud backups. ✓ Local Backup Feature: The app provides a local export feature to backup your data to your device. You are responsible for backing up your important content.

By downloading, installing, or using StudyMentorX ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
1.1 Agreement to Terms
These Terms constitute a legally binding agreement between you and StudyMentorX ("we," "us," or "our"). By using the App, you represent that you have read, understood, and agree to be bound by these Terms.

If you have created an account and provided an email address, we may also notify you via email. Updated Terms will also be posted in the App. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

These Terms are effective as of the date you first access or use the App, and remain in effect until terminated in accordance with these Terms.
2.1 What StudyMentorX Provides
StudyMentorX is an AI-powered educational application that provides three main features:
• AI Study Assistant: Step-by-step explanations for academic problems
• AI Writing Assistant: Assistance with improving essays, reports, and writing
• AI Exam Prep: Flashcards, quizzes, and study materials generation
2.2 AI-Powered Features
All features utilize artificial intelligence technology powered by third-party AI services (including but not limited to Google's Gemini AI). The App processes your input content through these AI services to generate educational assistance.
2.3 Service Availability
We strive to maintain continuous service availability but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
2.4 Global Service
Our services are available globally, subject to local laws and regulations. Users are responsible for ensuring their use complies with applicable local, national, and international laws.
3.1 Age Requirements
You must be at least 13 years old to use this App. Users under 18 years old must have parental or guardian consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms.
4.4 No Account Transfer
Your account is personal to you and may not be transferred, sold, or shared with any other person.
5.1 Permitted Uses
You may use the App for:

5.3 Personal Use Only
Your license to use the App is for personal, non-commercial use only. You may not use the App to provide services to third parties or for any commercial purpose.
5.4 Responsible Use
You must use the App responsibly and in accordance with your educational institution's academic integrity policies and honor codes.
You agree NOT to use the App for any of the following purposes:

• Interfering with or disrupting the App's functionality
• Using automated systems (bots) to access the App
• Attempting to overwhelm the App's servers or infrastructure
6.5 Reverse Engineering
• Decompiling, reverse engineering, or attempting to extract source code from the App
• Circumventing security features or usage limitations
• Creating derivative works based on the App
6.6 Misrepresentation
• Impersonating another person or entity
• Providing false information during registration
• Misrepresenting your affiliation with any institution
Violation of these prohibited uses may result in immediate termination of your account and access to the App.
7.1 Responsibility Statement
YOU ARE SOLELY RESPONSIBLE for ensuring your use of the App complies with your educational institution's academic integrity policies, honor codes, and codes of conduct. We do not assume any responsibility for violations of academic policies.
7.2 Institution Policies
Different educational institutions have different policies regarding AI assistance. You must:
• Understand and comply with your institution's policies on AI use
• Properly cite and acknowledge AI assistance when required
• Use the App as a learning tool, not as a means to avoid learning
• Verify all AI-generated content before using it in academic work
7.3 AI Assistance Disclosure
Many institutions require students to disclose when AI assistance has been used. You are responsible for making such disclosures when required by your institution.
7.4 Verification Requirements
AI-generated content may contain errors. You must:
• Verify all information before using it in academic work
• Understand the concepts presented, not just copy responses
• Consult with instructors when uncertain about proper use
• Take responsibility for the accuracy of work you submit
7.5 Learning Purpose
This App is designed to enhance learning, not replace it. Use the App to:

NOT to:
• Avoid doing your own work
• Submit AI-generated work as your own
• Bypass educational requirements
8.1 Subscription Plans
The App offers initial limited free usage and premium subscription plans. Premium features require a paid subscription with the following options:
• Monthly subscription
• Quarterly subscription
• Yearly subscription
8.2 Payment Processing
All payments are processed through Apple's App Store payment system. By subscribing, you agree to Apple's payment terms and conditions.
8.3 Automatic Renewal
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period.
8.4 Cancellation Policy
You may cancel your subscription at any time through your Apple account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.
8.5 Refund Policy
We do not issue refunds directly. All refund requests are subject to Apple's App Store refund policies and must be submitted through Apple. To request a refund:

• Provide your purchase receipt and reason for refund request
• Apple will review your request according to their policies

8.6 Price Changes

The App provides initial limited free usage to allow you to try the features. Once you reach the usage limit, you must subscribe to continue using the App. Premium subscriptions provide unlimited access to all features. We reserve the right to modify usage limits at any time.
8.8 Currency and Taxes
Prices are displayed in your local currency as determined by the App Store. Applicable taxes will be added at checkout as required by local law.
9.1 Our Ownership
The App, including all software, algorithms, design, text, graphics, logos, and other content (excluding user-generated content), is owned by StudyMentorX and protected by copyright, trademark, and other intellectual property laws worldwide.
9.2 Your Content Ownership
You retain all ownership rights to the content you submit to the App (text, images, documents, problems, questions). By submitting content, you represent that you own or have the right to submit such content.
9.3 License You Grant Us
By submitting content to the App, you grant us a worldwide, non-exclusive, royalty-free license to:
• Process your content through AI services to provide our features
• Store your content locally on your device
• Transmit your content to third-party AI service providers
• Use aggregated, anonymized data for improving our services
This license terminates when you delete your content or close your account, except for content that has been shared or cannot be practically removed.
9.4 AI Model Rights
Third-party AI service providers (such as Google) may use submitted content to train and improve their AI models according to their own terms of service. By using the App, you acknowledge and consent to this processing.
9.5 Trademarks
"StudyMentorX" and our logo are trademarks of our company. You may not use our trademarks without our prior written permission.
9.6 Copyright Infringement
We respect intellectual property rights. If you believe content in the App infringes your copyright, please contact us at support@getdigisolutions.com with:

9.7 Third-Party Content

You may submit various types of content to the App including:

10.2 Content Restrictions
You agree that content you submit will NOT contain:

10.3 Content Removal Rights

10.4 Backup Responsibility
You are responsible for maintaining backups of important content. The App provides a local export/backup feature that allows you to save your data to your device or share it. However, we do NOT provide cloud storage or automatic cloud backups of your study content. We are not responsible for loss of content due to technical issues, account termination, or any other reason.
10.5 Content Privacy
Your content is stored ONLY locally on your device - we do NOT store your study content on our servers or in the cloud. When you use AI features, your content is temporarily transmitted to third-party AI services for processing and then the response is stored back on your device. See our Privacy Policy for details.
10.6 No Monitoring Obligation
We are not obligated to monitor user content but reserve the right to do so for compliance, safety, and improvement purposes.
11.1 Nature of AI Output
AI-generated content is produced by artificial intelligence models and may contain:
• Inaccuracies or errors
• Outdated information
• Incomplete explanations
• Biased perspectives
• Mathematical or logical mistakes
11.2 Accuracy Disclaimers
WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT. AI systems can make mistakes, and you must verify all information independently.
11.3 Verification Required
You must:
• Verify all AI-generated answers and explanations
• Consult authoritative sources (textbooks, instructors, experts)
• Not rely solely on AI-generated content for important decisions
• Understand that AI may provide plausible-sounding but incorrect information
11.4 Educational Purpose Only
AI-generated content is provided for educational purposes only and should be used as:

NOT as:

11.6 AI Limitations
You acknowledge that AI technology:

• May not understand context fully

• May not account for regional, national, or institutional variations in educational requirements
• Output may vary based on the AI model version and training data
11.7 Your Responsibility
You are solely responsible for:
• How you use AI-generated content
• Verifying accuracy before use in academic work
• Complying with academic integrity policies
• Any consequences of using AI-generated content
11.8 Model Updates
AI models are regularly updated by third-party providers. Output may vary over time as models improve or change.
12.1 Google AI Services
The App uses Google's Gemini AI and other Google services to provide AI-powered features. Your use of these features is subject to Google's Terms of Service and Privacy Policy.
12.2 Apple Services
The App is distributed through Apple's App Store and uses Apple's payment processing. Your use is subject to Apple's Terms and Conditions.
12.3 Firebase Services (Google)
We use Firebase (Google) for backend services including Firestore database and Cloud Functions to store usage analytics, enforce usage limits, and operate backend APIs. Your data is processed in accordance with Firebase's Terms of Service and Google's Privacy Policy. Note: We do NOT use the Google Analytics SDK.
12.4 Qonversion Services
We use Qonversion for subscription management. Your subscription data is processed in accordance with Qonversion's Privacy Policy.
12.5 Third-Party Terms Apply
When you use features powered by third-party services, you agree to their respective terms of service and privacy policies. We are not responsible for third-party services.
12.6 No Endorsement

THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

14.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of business opportunities
• Damage to reputation

• Cost of substitute services
WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14.2 Maximum Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

WE ARE NOT RESPONSIBLE FOR:

• Rejection of work by instructors

• Consequences of using incorrect AI output

You agree to indemnify, defend, and hold harmless StudyMentorX, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Content you submit to the App
• Your violation of academic integrity policies
• Any negligent or wrongful conduct by you

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

You agree to cooperate fully with us in:

15.4 No Settlement Without Consent
You may not settle any claim without our prior written consent.
16.1 Termination by You
You may terminate your use of the App at any time by:
• Deleting the App from your device
• Cancelling your subscription through your Apple account
• Requesting account deletion through the App settings
16.2 Termination by Us
We may terminate or suspend your access immediately, without prior notice, for any reason including:

• Violation of applicable laws

• Abuse of the App or its features
• Non-payment of subscription fees
• Long periods of inactivity

16.3 Effect of Termination
Upon termination:

• Use the App's local export feature to backup your data before account deletion if needed
16.6 Subscription Cancellation
Cancelling your subscription does not automatically delete your account. You must separately request account deletion if desired.

17.2 Data Collection

IMPORTANT: We do NOT store your study content (problems, documents, AI responses) on our servers or in the cloud. Your content is stored locally on your device only.

We do NOT use your study content for any purpose other than processing your AI requests.

IMPORTANT: We do NOT send push notifications. If you have not created an account, you will NOT receive email notifications. We recommend creating an account to receive email notifications of important changes.
You should periodically check for updates to these Terms on our website or in the app.
18.3 Continued Use Constitutes Acceptance
Your continued use of the App after notification of changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.
18.4 Material Changes
For material changes that affect your rights or obligations, we will provide at least 30 days notice before the changes take effect, where required by law.
18.5 Review Regularly
You should review these Terms periodically. We will update the "Last Modified" date at the top of these Terms whenever changes are made.
19.1 Informal Resolution

For users in the European Union: Any disputes shall be resolved in the courts of your country of residence.
For users in the United States: Disputes shall be resolved in accordance with applicable state or federal law in your jurisdiction of residence.
For users in other jurisdictions: Disputes shall be resolved in accordance with the laws and courts of your country of residence, or as otherwise required by applicable law.

19.5 Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

You agree that any claim or cause of action arising from your use of the App must be filed within one (1) year after the claim arose, or as otherwise required by applicable law in your jurisdiction.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyMentorX regarding the App and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
20.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver on one occasion shall not constitute a waiver on any other occasion.

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.
20.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
• Acts of God (natural disasters, epidemics, pandemics)
• War, terrorism, civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Network outages or connectivity issues
• Power outages
• Third-party service failures (including AI service providers)
• Third-party AI service downtime or unavailability
• Changes or discontinuation of third-party AI models or services
20.6 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
20.7 Language
These Terms are provided in English. If translated, the English version controls in case of any conflict.
20.8 Electronic Communications
By using the App, you consent to receive electronic communications from us. These communications may include notices about your account and information about the App.
20.9 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as explicitly stated (e.g., Apple terms).
20.10 Independent Contractors
You and StudyMentorX are independent contractors. These Terms do not create any agency, partnership, joint venture, or employment relationship.
21.1 Acknowledgement
You acknowledge that these Terms are between you and StudyMentorX only, not with Apple Inc. ("Apple"), and that Apple is not responsible for the App or its content.
21.2 Scope of License
Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
21.3 Maintenance and Support
Apple has no obligation to provide maintenance or support services for the App. Any maintenance or support is provided by StudyMentorX as specified in these Terms or as required by applicable law.
21.4 Warranty
Apple is not responsible for any warranty claims relating to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you.
To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our responsibility.
21.5 Product Claims
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including:
• Product liability claims
• Claims that the App fails to conform to legal or regulatory requirements
• Claims arising under consumer protection or similar legislation
21.6 Intellectual Property Claims
Apple is not responsible for investigating, defending, settling, or discharging any claim that the App infringes a third party's intellectual property rights.
21.7 Export Compliance (Apple App Store Requirement)
As required by Apple for App Store distribution, you represent and warrant that:
• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties
Note: This is an Apple App Store requirement due to U.S. export control laws. Apple automatically enforces geographic restrictions for embargoed regions.
21.8 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
